Except for what otherwise agreed in writing, the delivery of the goods shall take place on DDU (Delivery Duty Unpaid”) at the destination agreed in the Selling Party’s special conditions.
The Purchasing Party undertakes to accept the delivery and unload the Products at its facilities under its own responsibility and at its cost.
All dates indicated as delivery terms are to be considered as merely indicative. A delay in the delivery shall not give the Purchasing Party the right to cancel the order or claim compensation for damage of any kind. By withdrawing and/or accepting a delayed delivery, the Purchasing Party shall waive in any case all claims with reference to the delay. In case of force majeure, interruptions in the manufacturing for any reason, strikes, the Selling Party’s responsibility for the delay shall be voided and the Selling Party shall have the right to terminate the agreement without the Purchasing Party being entitled to claim any compensation
